3. ACKNOWLEDGMENT OF RISKS
Helmet & Safety Responsibility*
I understand that operating an electric bicycle (e-bike) involves inherent risks, including but not limited to: Loss of control, collisions, or falls Road, trail, or surface hazards (gravel, sand, pavement defects, debris) Interaction with vehicles, pedestrians, or other cyclists Interaction with animals – both wildlife and domestic leashed Mechanical failure or malfunction of equipment Hazardous weather-related conditions Serious injury, disability, or death

4. ASSUMPTION OF RISK
I accept and assume full responsibility for all risks, known and unknown, associated with the use of the e-bike.*

5. HELMET & SAFETY RESPONSIBILITY
I understand that wearing a helmet is strongly recommended.*

I agree to follow all local, state, and trail rules and regulations.*

I certify that I am physically capable of operating an e-bike and that I am not under the influence of alcohol, drugs, or any substance that may impair my ability to ride safely.*

6. EQUIPMENT CONDITION & RESPONSIBILITY
I acknowledge that I have inspected the e-bike and equipment and find it in good working condition prior to use.*

I agree to return the e-bike and all equipment in the same condition, normal wear and tear excepted.*

7. TIMELY RETURN REQUIREMENT
I understand that my e-bike rental is reserved for a specific time and may be scheduled for use by other customers immediately after my rental period.*

I agree to return the e-bike on or before the agreed return time. A 10-minute grace period may be allowed. After this time, late fees will apply automatically.*

8. LATE RETURN AND CUSTOMER IMPACT FEES
I agree that if I return the e-bike after the grace period: I will be charged additional time at the applicable hourly rate Late charges may be rounded up to the next full hour If my delay impacts another customer’s reservation, I may be charged:A $50 inconvenience fee, andAny costs incurred by Trail Blazers to accommodate the affected customer

9. LOST/UNRETURNED EQUIPMENT
I understand that if I am 30 minutes past my return time without communication, I may be considered a “Lost Patron,” and additional fees may apply.*

If the e-bike is not returned within a reasonable time.*

10. EQUIPMENT DAMAGE / LOSS AGREEMENT
I accept full financial responsibility for any damage, loss, or theft of the e-bike and/or equipment during my rental period.*

I authorize Trail Blazers to charge my payment method on file for repair or replacement costs if necessary.*

11. RELEASE OF LIABILITY
To the fullest extent permitted under Illinois law, I hereby release, waive, and discharge Trail Blazers E-Bike Rentals and Sales, its owners, employees, and affiliates from any and all liability, claims, demands, or causes of action arising out of or related to: Personal injury Property damage Wrongful death Any loss sustained while using the e-bike
I agree that this release applies, to the greatest extent allowed by Illinois law, even if a claim for liability arises out of negligence by TrailBlazers E-Bike Rentals and Sales.*

12. PROHIBITED USES
By signing this waiver, I am specifically restricted from racing, doing stunts, reckless riding, adding a passenger or using the e-bike for hire to make money or generate compensation.*

13. INTENDED USES
By signing this waiver, I agree to always ride exclusively on or closely around the Jane Addams Trail and not relocate or transport any e-bike by other means at any time without authorization.*

14. INDEMNIFICATION
I agree to indemnify and hold harmless Trail Blazers E-Bike Rentals and Sales from any claims, damages, or expenses resulting from my use of the equipment.*

15. AGREEMENT & SIGNATURE
I have carefully read this agreement and fully understand its contents. I am signing this document voluntarily and intend for it to be legally binding.*

16. CREDIT CARD AUTHORIZATION & SECURITY HOLD
I understand that a valid credit or debit card is required to rent or test ride an e-bike.*

I authorize Trail Blazers E-Bike Rentals and Sales to place a temporary authorization hold of up to $500 on my card during the test ride period or up to $1000 during the rental period.*

I understand that this is not a charge, but a hold that may reduce my available balance until released by my bank.*

I authorize Trail Blazers to charge my card for any applicable fees, including but not limited to: *Damage to equipment, *Loss or theft, *Late returns, *Cleaning or misuse fees.*
